Terms of Use

These Terms of Use ("Terms") govern your use of the Trucker Budget mobile application and any related services (collectively, "the App"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

Eligibility

You must be at least 13 years old to use the App. If you are between 13 and the age of majority in your jurisdiction, you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using the App you represent that you meet these requirements and have the legal capacity (directly or through your guardian) to enter into these Terms.

License

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use the App on any Apple-branded device that you own or control, solely for your personal or business use.

This license does not give you the right to: copy, modify, or create derivative works of the App; reverse engineer, decompile, or disassemble the App except as permitted by applicable law; rent, lease, lend, sell, redistribute, or sublicense the App; remove any proprietary notices; or use the App to build a competing product.

Use of the App

The App is designed to help truck drivers track loads, expenses, income, paperwork, and related business information. You are responsible for ensuring that any information you enter is accurate and appropriate for your own records.

You agree not to use the App in any way that violates applicable law, infringes the rights of others, attempts to circumvent free-tier limits, interferes with the App's operation, or transmits malware or harmful content.

AI Features

The App offers two AI-powered features: Autofill, which extracts load details from rate confirmations, and Rate Fraud Detector, which evaluates rate confirmations for signs of tampering or fraud. These features rely on a third-party AI service (Google Gemini) to process the documents you choose to submit.

AI output is generated automatically and may be inaccurate, incomplete, or misleading. You acknowledge and agree that:

• You are responsible for reviewing and verifying every value extracted by Autofill before saving or relying on it.
• The Rate Fraud Detector is a screening tool only. A "clean" result is not a guarantee that a document is genuine, and a flagged result is not a guarantee that a document is fraudulent. You must use your own judgment and standard verification procedures (such as carrier vetting, MC number checks, and broker verification) before accepting any load.
• We do not warrant the accuracy, completeness, or reliability of any AI-generated output, and we are not liable for any decisions you make based on it.
• AI features may be modified, limited, or discontinued at any time, including without notice.

Your use of AI features is also subject to your acceptance of in-app consent prompts, which are disclosed in our Privacy Policy.

Subscriptions and Purchases

The App offers optional premium subscriptions that unlock additional functionality and remove free-tier limits. Subscription details, including price and billing period, are shown in the App at the point of purchase.

• Payment is charged to your Apple ID account at confirmation of purchase.
• Subscriptions automatically renew at the end of each billing period unless auto-renewal is turned off at least 24 hours before the end of the current period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period at the price of the selected subscription.
• You can manage and cancel subscriptions in your Apple ID account settings. Cancellation takes effect at the end of the current billing period; no partial refunds are provided for unused time.
• Refunds, where applicable, are handled by Apple in accordance with the App Store's refund policies.

Free Tier

The App offers a free tier with limited use of certain features (including a limited number of saved loads, transactions, and AI analyses). Free-tier usage counts are stored locally on your device and persist across reinstalls of the App. You agree not to attempt to circumvent these limits.

No Financial, Legal, or Tax Advice

The App provides tools for tracking and reporting information. It does not provide accounting, financial, legal, regulatory, or tax advice. Any totals, summaries, or reports generated by the App are for informational purposes only.

You are responsible for the accuracy of your own records and for complying with all applicable laws and regulations. You should consult a qualified professional for advice specific to your situation.

Data Responsibility and Backups

You are responsible for maintaining backups of your data. While the App may offer iCloud Sync through Apple CloudKit, we cannot guarantee data availability, recovery, or uninterrupted sync. You acknowledge that data loss can occur due to device failure, software errors, sync conflicts, or other causes outside our control, and that we are not responsible for any such loss.

Third-Party Services

The App integrates with third-party services including Apple iCloud / CloudKit, Apple StoreKit, Apple Maps (CoreLocation and MapKit), Google Gemini, and Google Firebase Analytics. Your use of those services is also governed by their own terms and privacy policies. We are not responsible for the acts, omissions, performance, or content of any third-party service.

Availability and Updates

We may update, improve, modify, suspend, or discontinue any feature of the App at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the App.

Termination

We may suspend or terminate your access to the App at any time, with or without notice, including if we believe you have violated these Terms or used the App in a way that creates risk for us, other users, or third parties. You may stop using the App at any time by uninstalling it.

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, AND UNINTERRUPTED OR ERROR-FREE OPERATION.

WE DO NOT WARRANT THAT THE APP, INCLUDING ITS AI FEATURES, WILL BE ACCURATE, COMPLETE, RELIABLE, OR SUITABLE FOR YOUR PURPOSES. YOU USE THE APP AT YOUR OWN RISK.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL TRUCKER BUDGET, ITS OWNERS, OR ITS AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, BUSINESS, GOODWILL, OR LOAD OPPORTUNITIES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE APP IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, OR (B) FIFTY DOLLARS (USD $50).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.

Indemnification

You agree to defend, indemnify, and hold harmless Trucker Budget and its owners and affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or connected with your use of the App, your violation of these Terms, or your violation of the rights of any third party.

Apple-Specific Terms

The following terms apply when you use the App on an Apple-branded device, in addition to the rest of these Terms:

• These Terms are concluded between you and Trucker Budget only, and not with Apple Inc. ("Apple"). Trucker Budget, not Apple, is solely responsible for the App and its content.
• Your license to use the App is limited to a non-transferable license to use the App on any Apple-branded device that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
• Apple has no obligation to provide any maintenance or support for the App.
• If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
• Trucker Budget, not Apple, is responsible for addressing any claims by you or a third party relating to the App, including product liability claims, claims that the App fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection or similar legislation.
• Trucker Budget, not Apple, is responsible for the investigation, defense, settlement, and discharge of any third-party intellectual property infringement claim relating to the App.
• You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
• Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

Governing Law and Disputes

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-law principles. You agree that any dispute arising out of or relating to these Terms or the App will be brought exclusively in the courts located in Ontario, Canada, except that nothing prevents either party from seeking injunctive relief in any court of competent jurisdiction.

If you are a consumer located outside Canada, mandatory consumer-protection laws of your country of residence may also apply, and nothing in these Terms is intended to override those rights.

Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected in the App or by updating the effective date above. Continued use of the App after changes means you accept the revised Terms.

Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.
